A Colorado judge has declared a mistrial in the case against the man accused of killing Paige Birgfeld, a mother of three who went missing in 2007 but whose remains were not discovered until 2012, PEOPLE has learned.

On Friday, Mesa County District Judge Brian Flynn declared the mistrial due to a hung jury, a spokeswoman tells PEOPLE.

After about three days of deliberations, the jury was unable to reach a unanimous decision in the trial of Lester Jones, who pleaded not guilty to charges of first-degree murder, second-degree murder and second-degree kidnapping in Birgfeld’s death.

Birgfeld, who was known by friends as a “supermom” who juggled several jobs to provide for her kids, vanished on June 28, 2007. Police later discovered that she ran an escort service and used the pseudonym “Carrie.”

Police previously said that they suspected Jones to be the killer since the beginning. Authorities allege Jones was a client and one of the last people to see the Grand Junction mother before she disappeared, according to CBS News.

Birgfeld’s car was found burning in a parking lot near her home the day after she disappeared.

After the mistrial, some of the jurors told CBS 4 that nine voted guilty, but three still felt they had reasonable doubt.

Birgfeld’s father, Frank Birgfeld, said he still grieves for his daughter.

“I’m not sure what this closure business is that people swing around. I’m not convinced what it is,” he told CBS 4. “It’s not like I forget my daughter because I have closure.”

The spokeswoman says officials will reconvene about the case on Friday, Sept. 16 to determine whether to refile the charges against Jones to try him again. CBS 4 reports the district attorney has indicated that he will refile the charges.
